QUESTIONS TO ASK
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
[ ] What is the specific change being proposed, in writing?
[ ] What data supports the change? Can I see it?
[ ] When would the change take effect?
[ ] Will the rest of the IEP stay the same, or are other parts being adjusted?
[ ] How will the change be documented, and when will I receive the updated IEP pages?
[ ] If I disagree with part of the amendment: can we agree to some changes and not others?

TALKING POINTS
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
[ ] "I want to see the proposed amendment in writing before I agree to anything."
[ ] "Under 34 CFR 300.324(a)(4), amendments by written agreement require both my consent AND the district's. I always have the right to ask for a full team meeting instead."
[ ] "If the team is reducing a service, I want to see the progress data that supports that decision."
[ ] "Any amendment we agree to today must be reflected in updated IEP pages and a Prior Written Notice under 34 CFR 300.503."

Frequently asked questions

Can the IEP be changed between annual reviews?
Yes. Under 34 CFR 300.324(a)(4), the parent and district can agree in writing to amend the IEP without a full team meeting. Or, either party can call an IEP meeting to amend the IEP at any time.
What kinds of changes can be made by amendment?
Any IEP element: services, frequency or duration, goals, accommodations, supplementary aids, placement, or progress reporting. Some districts require a full team meeting for placement changes regardless.
Do I have to agree to an amendment without a meeting?
No. You always have the right to request a full IEP team meeting. The amendment-without-meeting process is only available if both parties agree to use it.
What documentation should I get after an amendment?
A written record of the change, signed by all required parties, and updated IEP pages reflecting the amendment. Also request Prior Written Notice under 34 CFR 300.503 documenting the change.
What if the district refuses to amend?
Request Prior Written Notice under 34 CFR 300.503 documenting the refusal and the data the district relied on. If you disagree, you have the right to mediation, a state complaint, or due process.
